These terms are the agreement between you and Stoop when you use the site.

Stoop is a United States–based service. These terms are written for U.S. users and are governed by U.S. law. This page is general information, not legal advice.

1. Agreement to these terms

By creating an account, listing an item, messaging a neighbor, or otherwise using Stoop, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use Stoop. You must be at least 18 years old and able to form a binding contract under U.S. law.

2. What Stoop is — and is not

Stoop is a listing and messaging platform. It gives sellers one place to photograph, describe, price, and share the items they have for sale, and gives shoppers a way to browse neighborhood galleries and contact the seller.

Stoop is not a party to any transaction between users. We do not process payments, hold funds, escrow money, verify items, inspect condition, arrange shipping, print labels, or guarantee that any buyer or seller will complete a deal. Payment, pickup, delivery, and any refunds are arranged directly between the buyer and the seller, off the platform.

3. Accounts

You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. Notify us promptly if you suspect unauthorized use. We may suspend or terminate accounts that violate these terms.

4. Seller membership and billing

Browsing and messaging are free. Listing items requires a seller membership of $8 per month unless otherwise stated at signup. Membership renews automatically each month until you cancel, and is billed through our third-party payment processor. You may cancel at any time; cancellation takes effect at the end of the current billing period. Except where required by law, fees already paid are non-refundable. We may change pricing with at least 30 days' notice before the change applies to your next renewal.

5. Your content and license

You keep ownership of the photos, titles, and descriptions you upload. You grant Stoop a worldwide, non-exclusive, royalty-free license to host, store, resize, display, and distribute that content for the purpose of operating and promoting the service — including generating link previews when you share your gallery to other sites. This license ends when you delete the content, except for copies retained in backups or already shared by others.

You represent that you own or have the rights to the content you upload, that the items are yours to sell, and that your content does not infringe anyone's rights.

6. Prohibited items and conduct

You may not list, offer, or solicit:

  • Firearms, ammunition, explosives, or weapon parts.
  • Illegal drugs, controlled substances, tobacco, vaping products, or alcohol.
  • Stolen, counterfeit, or recalled goods.
  • Live animals, human remains, or bodily fluids.
  • Prescription drugs, medical devices, or supplements making health claims.
  • Hazardous materials, and anything else prohibited by federal, state, or local law.
  • Adult content, or services rather than physical goods.

You also may not:

  • Post false, misleading, or spam listings, or scrape the site.
  • Harass, threaten, or discriminate against another user.
  • Attempt to move payment off-platform through fraudulent instruments.
  • Interfere with the security or operation of the service.

We may remove content or suspend accounts at our discretion for violations, and may report unlawful activity to authorities.

7. Transactions between neighbors

Because Stoop is not involved in transactions, you are responsible for evaluating the other party, the item, and the meeting arrangements. Meet in a public place when possible, bring someone with you, inspect items before paying, and use a payment method you trust. See our best practices page. Sellers are responsible for accurately describing items and for any taxes owed on their sales.

8. Cross-posting to other marketplaces

Stoop helps you copy listing text and links for sites like Craigslist, Nextdoor, OfferUp, and Facebook Marketplace. Those platforms are independent, have their own rules, and are not affiliated with or endorsed by Stoop. You are responsible for complying with their terms.

9. AI-generated descriptions

Our AI assistant can suggest a title and description from a photo you upload. Suggestions are drafts and may be inaccurate. You are responsible for reviewing and editing anything you publish.

10. Copyright and DMCA

If you believe content on Stoop infringes your copyright, send a notice through our contact form that includes: identification of the work, the URL of the material, your contact information, a statement of good-faith belief that the use is unauthorized, a statement under penalty of perjury that the notice is accurate and that you are authorized to act, and your signature. We remove infringing material and terminate repeat infringers.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT LISTINGS, USERS, OR ITEMS ARE ACCURATE, LEGITIMATE, OR SAFE. Some states do not allow certain warranty exclusions, so parts of this section may not apply to you.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STOOP AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR PERSONAL INJURY ARISING FROM YOUR USE OF THE SERVICE OR FROM ANY INTERACTION OR TRANSACTION WITH ANOTHER USER. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF $100 OR THE MEMBERSHIP FEES YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless Stoop and its operators from claims, damages, and expenses (including reasonable attorneys' fees) arising out of your content, your use of the service, your transactions with other users, or your violation of these terms or of any law.

14. Dispute resolution and arbitration

Most concerns can be resolved by contacting us first. If a dispute cannot be resolved informally within 30 days, you and Stoop agree that it will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in the United States, rather than in court — except that either party may bring a qualifying claim in small-claims court.

You and Stoop each waive the right to a jury trial and to participate in a class or representative action. You may opt out of this arbitration agreement by sending written notice through our contact form within 30 days of first accepting these terms.

15. Governing law

These terms are governed by the laws of the State of California and applicable U.S. federal law, without regard to conflict-of-laws rules. Where arbitration does not apply, the state and federal courts located in California will have exclusive jurisdiction.

16. Termination and changes

You may stop using Stoop and delete your account at any time. We may suspend or terminate access for violations or to protect the service. We may update these terms; material changes will be posted in the app or emailed before they take effect, and continued use after that date means you accept them. If any provision is unenforceable, the rest remains in effect.
